NEWMARKET ZONING BOARD OF ADJUSTMENT MEETING

 

JUNE 29, 2015

 

MINUTES

 

Present:           Chris Hawkins (Chairman), Wayne Rosa (Vice Chairman), Bob Daigle, Richard Shelton (Alternate), Steven Minutelli (Alternate)

 

Absent:            Jonathan Kiper (excused), Steven Minutelli (unexcused)

 

Called to order:           7:00 p.m.

 

Adjourned:                  7:08 p.m.

 

Agenda Item #1 – Pledge of Allegiance

 

Agenda Item #2 – Review & approval of minutes: 06/15/15

 

            Action

Motion:          Bob Daigle made a motion to accept the minutes with the following amendment:  On page 4, line 13. “…they should be asking for a variance to allow a variance…” should state “…asking for a variance to allow four units…”.

                       

            Chairman Hawkins stated he had a correction on the last page, it says, “He has heard”.  He would like it to say, “The applicant has heard.”

Agenda Item #3 – Regular Business

 

Waterway Realty LLC – Continuation of a public hearing on an application for two (2) variances to allow the subdivision of an existing 19.96 acre lot into two tracts: (1) a 4.00 acre tract to remain with the existing structures, and (2) a 15.96 acre tract for future development.  The property is located at 310 Wadleigh Falls Road, Tax Map R-5, Lot 85, R-1 Zone. The following variances have been requested:

1.  A variance from Section 1.05 (C) (1) to allow a boundary adjustment on a non-conforming lot, which does not bring the lot into closer conformance with the Ordinance.

2. A variance, from Section 3.03(B) of the Newmarket Zoning Ordinance to allow four units on a four acre lot, where, under the maximum residential density requirement of ½ unit per acre, eight acres of land would be required.  The lot is located at 310 Wadleigh Falls Road, Tax Map R5, Lot 85, R1 Zone. 

 

            Chairman Hawkins stated the applicant has requested a continuance to Monday, July 13, 2015 at 7:00 p.m. at Town Hall.

Agenda Item #4 – New/Old Business

 

            Diane Hardy stated there was a procedural matter that she wished to bring to the Board’s attention.  The Aviles application is scheduled to be heard on July 6, 2015.  That was the date certain the Zoning Board established for that application and that was the date that Mr. Aviles requested.  Diane Hardy stated Mr. Aviles has asked for the hearing to be postponed until the end of August, because he found a full survey of the property is necessary.  She asked the Board if they wished to come back on July 6 and vote to continue the application to a date in August.  If the Board chose to do this there would be no need to re-notice the application.  If the Board decides they would rather not meet on July 6th and instead vote on this tonight, the application will have to be re-noticed.  There was a discussion of whether to vote this evening or on July 6th.  The Board decided to meet on July 6th and continue the application to late August.
