LEGAL NOTICE

TOWN OF NEWMARKET, NEW HAMPSHIRE

There will be a public hearing on Wednesday, November 19, 2008, Town Council Chambers, to amend Title III:  Land Use Code and Regulations, Chapter IV:  Zoning Ordinance, in accordance with RSA 675:6 and 675:7.

Proposed amendments are described below:

1.            Section 2.01 M-1 District (B) Permitted Uses - Adding a new paragraph to 2.01 (B)(2).  The amendment would allow Mixed Use Mill Redevelopment in the M-1 District by Special Use Permit, granted by the Planning Board; provided certain conditions are met.  

2.            Section 1.00 Administrative Provisions, 1.11 Definitions.  Definitions for the following are being added:  Mixed Use Redevelopment and Artist Live/Work Space Units.

3.         Add to second line of Section 1.09 Special Use Permit paragraph (A) – “Section 2.01(B)(2)(b) for multi-family residential uses as part of a Mixed Use Mill Redevelopment,”

4.            Amendments to the Table of Permitted Uses pertaining to the M-1 District.

5.            Amendments to the Dimensions Table pertaining to the M-1 District.

6.         Revise Section 7.02 Mixed Use Development by adding the following language to Section 7.02(C)(1) “Mixed Use Redevelopments within the M-1 District are subject to the Special Use Permit Requirements as set forth in Section 2.01(B)(2)(b)”
